1. Acceptance of Terms

By accessing or using Abstrakt's services, website, and API (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and Abstrakt, Inc. ("Abstrakt," "we," "us," or "our"). Abstrakt provides a unified API platform that enables developers to access various artificial intelligence models and services through a single interface. Our Services include, but are not limited to:

• Customer support services

3. Account Registration

To access certain features of the Services, you must register for an account. When registering, you agree to:

• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

6. Fees and Payment

Fees are non-refundable except as required by law or as explicitly stated in our refund policy. We may change our pricing with 30 days' notice.

Your Content

You retain ownership of any content you submit to the Services. By submitting content, you grant us a limited license to process and store that content as necessary to provide the Services. We do not claim ownership of your generated outputs.

Generated Content

Subject to these Terms, you own the outputs generated through your use of the Services. However, similar outputs may be generated for other users, and we make no guarantees of uniqueness.

8. Third-Party Services

Our Services may integrate with or rely on third-party AI providers and services. Your use of such third-party services may be subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or content of third-party services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. AI-generated content may contain errors, inaccuracies, or inappropriate material.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABSTRAKT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Abstrakt and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time through your account settings or by contacting us.

Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Abstrakt regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver.
